Agreement

By using Rockport Birding HQ (rockportbirdinghq.com), you agree to these terms. The site is operated by CAP Creative Solutions, a Texas sole proprietorship. If you do not agree, please do not use the site.

Use of the Site

Rockport Birding HQ is a free birding guide and community resource. You may:

• Browse all content freely
• Submit bird sightings for community review and publication
• Sign up for migration alert emails
• List a birding-friendly vacation rental through the Bird-Nest program

You may not use the site to submit false, misleading, or harmful content.

Bird Sighting Submissions

When you submit a bird sighting, you grant Rockport Birding HQ a non-exclusive license to display your submission (including photo, species, location, and photographer name) on this site. We review all submissions before publishing. We may decline or remove any submission at our discretion. You retain ownership of your photos.

Bird-Nest Vacation Rental Listings

The Bird-Nest program allows property owners to advertise birding-friendly vacation rentals for $20/month, billed via Stripe subscription.

• Approval required: All listings are reviewed before payment is collected. Submission does not guarantee approval.
• Accuracy: You are responsible for ensuring your listing information is accurate and up to date. Misleading listings will be removed without refund.
• Cancellation: You may cancel your subscription at any time through Stripe. Your listing will be deactivated at the end of the current billing period.
• Refunds: Monthly subscription fees are non-refundable except at our sole discretion. If we reject or remove a listing, we will refund any payment made for that billing period.
• Removal: We reserve the right to remove any listing that violates these terms, contains false information, or is no longer appropriate for the site.

Payments

Payments are processed by Stripe. By making a payment, you also agree to Stripe's Terms of Service. CAP Creative Solutions does not store payment card information.

Intellectual Property

All original content on this site — text, images, design, and code — is owned by CAP Creative Solutions unless otherwise noted. You may not reproduce or republish site content without written permission. User-submitted content (bird sightings, photos) remains the property of the original contributor.

Disclaimer of Warranties

Rockport Birding HQ is provided "as is" without warranties of any kind. Birding information, species sightings, and wildlife viewing conditions change constantly. We make no guarantees about accuracy, availability, or fitness for a particular purpose. Always verify current conditions with local authorities before planning a trip.

Limitation of Liability

CAP Creative Solutions is not liable for any indirect, incidental, or consequential damages arising from your use of this site, reliance on information presented, or interactions with third-party services (including vacation rental hosts listed in Bird-Nest). We are a directory — we do not manage, inspect, or guarantee any listed properties.

Governing Law

These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Aransas County, Texas.
